The plaintiff that files the lawsuit is defined as the class representative. This plaintiff represents the legal issues that hundreds or hundreds of thousands, are having with the defendant.

Class action lawsuits are typically filed against large corporations or to facilitate change in the government. There are many advantages to filing a class action lawsuit, since there is power in large numbers. This method will hold a defendant who violates the law accountable and enforce compensation to the class members. When a defendant breaks the law and causes widespread harm, those harmed by their actions are entitled to sue for damages or sue for certain action. For example, landmark Civil Rights cases like Brown v. Board of Education (1954), NAACP v. Alabama (1958), and Heart Atlanta Motel Inc. v. United States (1964) were filed to obtain specific actions like the integration of public schools.

The Class Action Fairness Act of 2005 states, “Class action lawsuits are an important and valuable part of the legal system when they permit the fair and efficient resolution of legitimate claims of numerous parties by allowing the claims to be aggregated into a single action against a defendant that has allegedly caused harm.” This act increased federal jurisdiction in class action lawsuits in an effort to prevent abuse that may harm the class members and defendants.
